The Meijer request for rezoning and a special-use planned unit development for the property at Maple and Benedictine in Lisle is illegal. It violates well-established state law and the village of Lisle zoning ordinance. The village of Lisle trustees and the mayor have been furnished with legal memorandums, explaining the law and how it applies to the Meijer proposal in detail as well as an eight-page letter from the law firm of Rathje, Woodward, Dyer and Burt that summarizes the legal defects in the Meijer rezoning request. The mayor has attempted to characterize the applicable law as merely a "point of view." The next time you get a speeding ticket, try telling the judge that the posted speed limit is just a "point of view."

Everyone is entitled to their own opinion, but no one is entitled to their own facts. It is a fact that the special-use planned unit development that Meijer has proposed is illegal.

If a legislative body (like the village board) passes legislation that is illegal, it is the proper function of the judiciary to correct that wrong. If a lawsuit is filed, it will only be because the village board chose to ignore the law.

The village board can save a great deal of time, energy and taxpayers' money if they simply do the right thing, obey the law and deny Meijer's request for rezoning.
